Employee Handbooks:

Employee handbooks are vital to the employer-employee relationship. Most employer handbooks lay out the employees salary, benefits, length of employment (at will or contract), your right to job reviews, company discipline procedures, vacation and holiday terms, etc. The employee handbook may – and often time will be – considered a form of an employee contract, especially where specific terms of employment are spelled out (such as salary and length of employment). Where the employee handbook is not followed by the employer in these cases, employees have been increasingly successful in successfully suing their employers. For employers putting together handbooks, to avoid possible lawsuits, it’s best not to include specific disciplinary procedures, otherwise you must follow them. Likewise, if you stipulate that the employment situation cannot end without just cause, you are cutting deep into the employee at will scenario, i.e., you must then provide just cause before termination. In general, avoid making promises – especially unnecessary ones. For the most part, employee handbooks should stick to generalities – include information about the company, pay periods, dress codes, sexual harassment policies, vacation and holiday pay, etc. It may also be wise to include a disclaimer of some sort stating that the employee handbook is not a legal contract and the employee reserves the right to end the employment relationship at any time, for any (legal) reason.
